Solicităm revizuirea cerinței privind livrarea iaurtului în ambalaj de 125 g, deoarece aceasta restrânge nejustificat concurența și limitează participarea operatorilor economici care oferă același produs în alte gramaje uzuale.
Considerăm că impunerea unui gramaj fix, fără acceptarea produselor echivalente, contravine principiilor concurenței loiale, tratamentului egal și utilizării eficiente a fondurilor publice.
Solicităm modificarea specificației prin acceptarea unui interval rezonabil de gramaj sau a produselor echivalente, pentru a asigura participarea unui număr mai mare de ofertanți și desfășurarea unei proceduri competitive reale.
În cazul menținerii acestei cerințe fără o justificare obiectivă, ne rezervăm dreptul de a sesiza autoritățile competente.

Bună ziua! Autoritatea contractantă a examinat solicitarea privind revizuirea cerinței referitoare la livrarea iaurtului în ambalaj de 125 g. În urma analizei, comunicăm că necesitatea privind porționarea produsului rămâne actuală, motiv pentru care autoritatea contractantă nu consideră necesară modificarea specificației tehnice.
Totodată, în vederea asigurării unei concurențe efective și a participării unui număr cât mai mare de operatori economici la procedura de achiziție, autoritatea contractantă precizează că vor fi acceptate și produse echivalente cu gramaj cuprins între 120 g și 180 g, cu respectarea tuturor celorlalte cerințe prevăzute în documentația de atribuire.
Prin urmare, cerința privind livrarea iaurtului în ambalaj de 125 g se menține, fiind acceptate și produse cu gramaj cuprins între 120 g și 180 g, considerate echivalente și corespunzătoare necesităților autorității contractante. Vă mulțumim, o zi bună!
