Question:
Solicitam sa admiteti o marja de eroare pentru dimensiuni de cel putin 10%, in caz contrar aceasta este o achizitie dintro singura sursa de la SC ECHIM ART SRL. In caz ca refuzati admiterea unei marje de eroare la dimensiuni, solicitam sa indicati expres standardul care solicita anume dimensiunile dein caietul de sarcin si nu altele. Va multumim pentru transparenta si echidistanta.
Answer (30 Apr 2026, 11:01):
Autoritatea Contractantă precizează că dimensiunile solicitate sunt stabilite în raport cu modelul de pahar de degustare tip ISO/INAO (ex. ISO 3591:1977), fiind esențiale pentru asigurarea funcționalității și uniformității utilizării.
Marja de ±10% este considerată excesivă, întrucât ar conduce la modificarea proporțiilor și caracteristicilor produsului.
Se admite o toleranță (marja de eroare) de ±3% pentru dimensiunile liniare, corespunzătoare/admisibile in cadrul proceselor de fabricație/producere.
Totodată, menținerea acestei toleranțe este necesară pentru compatibilitatea cu port-paharul și utilizarea sigură în cadrul evenimentului .
Autoritatea Contractantă respinge afirmația privind caracterul de „sursă unică” al achiziției.
Produse conforme cu specificațiile solicitate sunt disponibile pe piața europeană de la mai mulți producători, inclusiv din state precum Spania, Italia, Austria sau Polonia.
Specificațiile tehnice au fost stabilite în mod obiectiv, în raport cu necesitățile funcționale ale proiectului/eveniment, fără a avea ca efect restrângerea concurenței.
Prin urmare, solicitarea de admitere a unei marje de ±10% se respinge.
