Modelul indicat în documentația de achiziție este orientativ și are rolul de a defini cerințele tehnice minime.
Se acceptă echipamente echivalente, cu condiția respectării integrale a cerințelor tehnice și funcționale stabilite în documentația de atribuire, acestea fiind parte a soluțiilor tehnologice din proiectul de execuție.
Conform art. 37 alin. (6) din Legea nr. 131/2015 privind achizițiile publice, indicarea unor mărci sau modele în specificația tehnică este permisă doar cu titlu orientativ și nu are ca efect limitarea concurenței.
Sintagma „sau analogic acestuia” se consideră echivalentă cu formularea „sau echivalent”, în sensul legislației în vigoare.
Se acceptă ofertarea oricărui echipament echivalent, cu condiția respectării integrale a cerințelor tehnice și funcționale stabilite în documentația de atribuire.

Capacitatea indicată de 1200–1400 litri pentru frigidere cu 2 uși se încadrează în cerințele tehnice minime stabilite în documentația de atribuire, cu condiția respectării integrale a tuturor parametrilor tehnici și funcționali solicitați.
Se acceptă echipamente echivalente care îndeplinesc cerințele minime prevăzute în documentația de atribuire.

in clarificarea precedenta ati notat ca sa incadreaza un interval de litraj in cerintele indicate, insa acest interval presupune devieri la aspect de dimensiuni si putere, un frigider de 1300 lt versus altul de 1400 lt presupune dimeniuni diferite si putere la fel, de cele solicitate de dvs. intrebare - sunt admisibile devieri de dimensiuni si putere solicitate in caiet de sarcini, insa care sunt conform clarificarii dvs de acceptare a intervalului de litraj?

Acceptarea acestui interval de litraj nu presupune modificarea celorlalți parametri tehnici stabiliți în caietul de sarcini, ofertanții pot propune echipamente cu capacitate între 1200 și 1400 litri, cu condiția ca dimensiunile exterioare, puterea instalată și toți ceilalți parametri tehnici să fie conformi cerințelor specificate în caietul de sarcini.
