Necesitatea avizul de expertiza in domeniul securitatii industriale.
Question:
Bună ziua stimată AC.
Conform prevederilor art. 9 alin. (3) din Legea nr. 151 din 09-06-2022 privind funcționarea în condiții de siguranță a obiectivelor industriale și a instalațiilor tehnice potențial periculoase,“Operatorul sau persoana juridică specializată poate să activeze în domeniul securității industriale în cazul în care obiectivul industrial sau instalația tehnică este înregistrată în Registrul de stat și dacă acesta/aceasta dispune de personal calificat care deține permise de exercitare și/sau certificate de competență”.
Norma de drept precitată supra scoate în evidență faptul, că în vederea desfășurării activității de prestare a serviciilor de reparare şi de întreţinere a instalaţiilor de construcţii (ascensoare, dispozitive de ridicare, platforme pentru invalizi) nu este necesară avizul de expertiză în domeniul securității industriale.
Întrebarea este, dacă nu ar fi cazul ca prin intermediul prezentei clarificări să fie exclusă această cerință din caietul de sarcini și documentația standard, astfel că menținerea acesteia să nu servească drept temei juridic de descalificare a Operatorilor economici participanți, ceea ce va reprezenta un abuz și o ilegalitate din partea AC.
