Answer (19 Nov 2025, 10:00):
Potrivit Hotărârii Guvernului nr. 986/2018 pentru aprobarea Regulamentului privind modul de ținere a Registrului de stat al achizițiilor publice, format de Sistemul informațional automatizat „Registrul de stat al achizițiilor publice” (MTender), precum și Hotărârii Guvernului nr. 10/2023 pentru aprobarea Regulamentului privind activitatea grupului de lucru în cadrul procedurilor de achiziții publice, în procesul de desfășurare a procedurilor de achiziție publică se operează exclusiv cu documente oficiale, semnate sau aprobate în modul corespunzător, conform prevederilor legale.
Documentele utilizate în cadrul procedurii urmează să producă efecte juridice, iar aceste efecte sunt generate doar de actele semnate în mod corespunzător, respectiv, în cazul dat, prin semnătură electronică calificată.
În acest context, documentele plasate în SIA RSAP/MTender sunt semnate cu semnătură electronică pentru a produce efecte juridice la toate etapele de derulare și evaluare a procedurii de achiziție publică, inclusiv în ceea ce privește solicitările de clarificări, comunicările oficiale și eventualele contestații.
