DECLARAŢIE privind confirmat prin semnatura electronica a participantului Obligatoriu confirmarea identității beneficiarilor efectivi și neîncadrarea acestora în situația condamnării pentru participarea la activităţi ale unei organizaţii sau grupări criminale,pentru corupţie, fraudă şi/sau spălare de bani. APROBAT prin OrdinulMinistrului Finanțelornr. 145 din 24 noiembrie 2020- acest document se prezinta doar de catre OE desemnat cistigator. Acest lucru este scris chiar in textul declaratiei. Asa ca solicitarea de a prezentarea acetuia OBLIGATORIU de la toti participantii este una absurda. Schimbati parametrii de calificare in anunt prin excluderea acestei solicitari.

Conform art.29,al.4 al Legii Achizitiilor Publice, Autoritatea contractantă are dreptul de a stabili în scopul transparentei maxime cerintele privind eligibilitatea operatorilor economici ,aceasta cerinta fiind considerata utila pina la desemnarea O.E.cistigator.Aceasta n-ar trebui sa fie un impediment pentru prezentarea documentelor.
