Question:
LEGE Nr. 131 din 03.07.2015 privind achiziţiile publice Articolul 37 (4) Specificațiile tehnice nu vor face referinţă la o anumită marcă comercială sau la un anumit agent 3/19/2018 lex.justice.md/md/360122/ http://lex.justice.md/md/360122/ 22/54 economic, la un brevet, o schiţă sau un tip de bunuri, de lucrări şi de servicii, nu vor indica o origine concretă, un producător sau un operator economic concret. În cazul în care nu există un mod suficient de exact de expunere a cerinţelor faţă de achiziţie, iar o astfel de referinţă este inevitabilă, caracteristicile vor include cuvintele „sau echivalentul”.
În specificatia pentru lotul 3 este menționată marca Trimble, ceea ce contravine legislatiei privind achizitiile publice. Rugam sa inlocuiti doar cu parametrii tehnici necesari pentru acest echipament. In caz contrar vom contesta Specificația la ANSC.
Answer (15 Oct 2019, 14:01):
Bună ziua. Ce ține de lotul 3 marca comercială „ Trimble ” este inclusă deoarece Agenția pentru Supraveghere Tehnică deține echipament GNSS „ Trimble R6-2 ” iar modemul radio încorporat este anume pentru echipamentul dat.
Astfel dacă scrim doar caracteristicele și parametrii tehnici atunci nu îl vom putea conecta fizic cu echipamentul sus menționat.
Iar punctul 1.1 din același lot trebuie să dețină aceeași parametri tehnici pentru a se putea conecta cu modemul radio menționat în punctul 1.2.
