Semnătura electronică vs ștempilă
Question:
La DUAE se solicită aplicarea semnaturii electronice (semnatura si stampila intreprinderii). Dacă documentul ștampilat se scanează - deja nu mai este original. Respectiv cele două cerințe se exclud reciproc. Este oare suficientă aplicarea semnăturii electronice calificate avansate în baza Legii Nr. 91 din 29.05.2014 privind semnătura electronică şi documentul electronic?
Answer (9 Jul 2019, 14:46):
Buna ziua, IP Oficiul Național al Viei și Vinului, vine cu următorul răspuns: 1- Conform art.33, alin.14, lit.i) din Legea achizițiilor publice nr. 131 din 03.07.2015, unde este menționat ,, că pe ofertele electronice este aplicată semnătura electronică”, respectiv, documentul scanat și ulterior încarcat pe platforma electronică SIA RSAP ( M-tender) , urmează a fi semnat electronic, pentru confirmarea autenticității.
